         C.  Each individual speaker will be limited to a presentation total of three (3) minutes, or such other time as may be designed by the Chair.

         D. Speakers are encouraged to keep your comments, brief and to the point, and not to repeat prior testimony, so that as many people as possible can be heard.  Your cooperation is appreciated.

5.1.
RESOURCE MANAGEMENT ANGENCY - A. PRADO, DIRECTOR OF PLANNING AND BUILDING-Hold a public hearing and consider adoption of a resolution that would (1) Certify the John Smith Road Landfill Expansion Project (SCH# 2021020371) Environmental Impact Report (EIR) and adopt the California Environmental Quality Act (CEQA) Findings of Fact and Statement of Overriding Considerations and Mitigation Monitoring Report Program for the John Smith Road Landfill Expansion Project for purposes of the conditional use permit; (2) Approve a conditional use permit for the John Smith Road Landfill Expansion Project on 388.05 acres located on the north side of John Smith Road (2650 John Smith Road; APNs 025-190-078 and 025-190-079) to allow the addition of 388.05 acres to the existing 95.16-acre John Smith Road Landfill (APNs 025-190-072, 025-190-073, and 025-190-074) that would increase the landfill's capacity, expand the total waste footprint, increase the maximum elevation of the final landfill, increase the maximum permitted daily tonnage from 1,000 tons per day (tpd) to the proposed 2,300 tpd or lower tonnage approved by the Planning Commission, identify the haul route for commercial trucks from the proposed or alternative routes studied in the EIR, and adopt the composing alternative studied in the EIR; (3) Recommend the Board of Supervisors certify the John Smith Road Landfill Expansion Project (SCH# 2021020371) EIR and adopt the CEQA Findings of Fact and Statement of Overriding Considerations and Mitigation Monitoring Report Program for the John Smith Road Landfill Expansion Project for the General Plan amendment; and (4) Recommend the Board of Supervisors adopt a General Plan amendment that would change the General Plan Land Use Designation from Rangeland (R) and Agricultural (A) to Public/Quasi-Public (PQP) on the John Smith Road Landfill Expansion Project parcels (APNs 025-190-078 and 025-190-079) and amend the land use diagrams in the General Plan to reflect the change to the land use designations, including Figures 3-1, 3-2, 3-4, 3-5, and 3-6 of the Land Use Element of the General Plan.SBC FILE NUMBER:790

ADJOURNMENT

NOTE: A copy of this Agenda is published on the County's Web site by the Friday preceding each Commission meeting and
may be viewed at www.cosb.us. All proposed agenda items with supportive documents are available for viewing at the San
Benito County Administration Building, 481 Fourth Street, Hollister, CA between the hours of 8:00 a.m. & 5:00 p.m., Monday
through Friday (except holidays.) This is the same packet that the Planning Commission reviews and discusses at the
Commission meeting. The project planner's name and email address has been added at the end of each project description.
As required by Government Code Section 54957.5 any public record distributed to the Planning Commission less than 72
hours prior to this meeting in connection with any agenda item shall be made available for public inspection at the Planning
Department, 2301 Technology Parkway, Hollister, CA 95023. Public records distributed during the meeting will be available for
public inspection at the meeting if prepared by the County. If the public record is prepared by some other person and
distributed at the meeting it will be made available for public inspection following the meeting at the Planning Department.
APPEAL NOTICE: Any person aggrieved by the decision of the Planning Commission may appeal the decision within ten (10)
calendar days to the Board of Supervisors. The notice of appeal must be in writing and shall set forth specifically wherein the
Planning Commission's decision was inappropriate or unjustified. Appeal forms are available from the Clerk of the Board at the
San Benito County Administration Office, 481 Fourth Street, Hollister and the San Benito County Planning Department, 2301
Technology Parkway, Hollister.
